What the court actually decided
On 17 September the Constitutional Court declared the Public Procurement Act of 2024 unconstitutional and invalid. The problem was process, not policy. The court did not fault a single provision of the Act itself. A new chapter was added while the Bill was still before Parliament, and the public was never given a proper chance to comment on it. That fell short of Parliament’s constitutional duty to involve people in law-making. Treasury has since said it will start the legislation again, and Finance Minister Enoch Godongwana called it a return to the drawing board.

Your current bids carry on
The court did not suspend its order, and that detail matters more than the headline does. The Act had never been brought into operation, so there is no vacuum to manage. The procurement rules you already bid under stay in force, and nothing changes for a tender you are working on right now. There is no gap and there is no pause. Keep bidding and keep your compliance documents current. Treasury has not said when a replacement bill will appear, so watch for it rather than wait for it.

Where the real constraint sits
The State of the SMME in South Africa 2026 report landed on the same day. It found that small businesses are more confident than they were a year ago, and many now describe themselves as growing. Asked what would help them grow further, owners put access to markets first, ahead of financial support and digital tools. Most say better access to funding would make them more competitive, yet well over half have never applied for any. Arthur Goldstuck, CEO of World Wide Worx, which ran the research, put it plainly: “An order from a large customer can create a significant opportunity, but a small business also needs the working capital and capacity to deliver on it.”

What to do next: Carry on bidding under the current rules and keep your compliance documents up to date. Watch for Treasury’s replacement bill, but do not plan around a date that has not been set. Soweto electrical contractor secures bulk cable supply via Purchase Order Financing (POF)
A specialist electrical SMME won a public contract to supply overhead conductors to a national transport utility. The supplier demanded cash upfront before releasing the specialised wires, creating an immediate capital gap. We funded the supplier directly to release the materials, enabling the contractor to deliver on schedule. The utility settled the account directly on delivery, protecting the contractor’s margin.
